What happens if you break it

  • Illegal strike or lock-out

    §86

    Worker: fine ₹1,000 – ₹10,000 and/or imprisonment up to 1 month; Employer: fine ₹50,000 – ₹10 lakh and/or imprisonment up to 1 month.

  • Retrenchment / lay-off / closure without permission (large units)

    §86(8)

    Fine ₹1 lakh – ₹10 lakh and continuing daily fine until compliance.

  • Failure to make payment due under settlement / award

    §86(5)

    Fine ₹50,000 – ₹2 lakh; on repeat — imprisonment up to 3 months and/or fine up to ₹5 lakh.
