What happens if you break it

  • Falsifying a registered GI / applying false GI to goods

    §39

    Imprisonment 6 months – 3 years + fine ₹50,000 – ₹2 lakh.

  • Selling goods to which false GI is applied

    §40

    Imprisonment 6 months – 3 years + fine ₹50,000 – ₹2 lakh.

  • Subsequent offence

    §41

    Imprisonment 1 – 3 years + fine ₹1 lakh – ₹2 lakh.

  • Falsely representing GI as registered

    §42

    Imprisonment up to 3 years and/or fine.
