The Consumer Protection Act, 2019

Replaces the 1986 Act. Creates the Central Consumer Protection Authority, the District/State/National Commissions, product liability, e-commerce rules, and mediation.

Penalties

What happens if you break it

  • Manufacture / sale / import of adulterated or spurious goods

    §90, §91

    If injury: imprisonment up to 7 years + fine up to ₹5 lakh; if death: imprisonment 7 years to life + fine ≥ ₹10 lakh.

  • Misleading advertisement (manufacturer / endorser)

    §89

    Imprisonment up to 2 years + fine up to ₹10 lakh; repeat — up to 5 years + ₹50 lakh.

  • Non-compliance with order of Consumer Commission

    §72

    Imprisonment 1 month – 3 years and/or fine ₹25,000 – ₹1 lakh.

  • Product liability (defective product causing harm)

    §82–87

    Compensation by the product manufacturer / seller / service provider — strict liability.
